Use the site honestly. The content is ours. Booking a call does not lock either of us into a contract — that needs a separate written agreement. Portuguese law applies.
1. Acceptance
By accessing or using elypt.io (the “site”), you agree to these Terms of Service. If you do not agree, please do not use the site.
2. What this site is
Elypt is a web design studio. This site exists to describe what we do, let you book a discovery call with us, and publish our written thinking on web design.
Booking a discovery call is not a contract for services. A service relationship begins only after a separate written engagement letter or contract is signed by both parties.
3. Use of the site
When you use this site, you agree to:
- Use the site lawfully and in good faith.
- Provide accurate information when you fill in our booking form.
- Not interfere with the site's operation, security, or availability.
- Not scrape, copy, or extract content using automated means, except as permitted by our robots.txt and standard search-engine indexing.
We may decline bookings or restrict access at our reasonable discretion, including to prevent abuse.
4. Intellectual property
All content on this site — including text, design, code, images, motion, and layout — is owned by Elypt or licensed to us. The Elypt name and brand identity are our trademarks.
You may:
- Read and personally reference our content.
- Quote short excerpts with clear attribution and a link back to the source.
You may not, without our prior written consent:
- Republish our content on another site or publication.
- Use our content to train AI models, language models, or similar systems.
- Copy our design, code, layout, or interactive elements for use on your own commercial site.
- Use our brand assets, name, or marks to suggest endorsement, partnership, or affiliation.
5. Third-party services
If you book a discovery call, we use Google Calendar to schedule it and Google Meet to conduct it. Your use of those services is governed by Google's own terms and privacy policy. We are not responsible for the operation of third-party services.
6. Disclaimers
The blog and other written content on this site is educational and reflects our experience and opinions. It is not formal business, legal, financial, or technical advice. Apply it to your own situation with appropriate professional input.
We work hard on the site but provide it “as is” and “as available”. We do not warrant uninterrupted availability, error-free operation, or that the site will be free of viruses or malicious code.
7. Limitation of liability
To the maximum extent permitted by applicable law, Elypt is not liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the site.
- Loss of profit, revenue, data, or goodwill.
- Any matter beyond our reasonable control.
Our total aggregate liability to you for any claim related to the site is limited to €100, except where applicable law requires otherwise (for example, in the case of gross negligence, willful misconduct, or non-waivable consumer rights).
8. Indemnification
You agree to indemnify and hold Elypt harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the site or your breach of these Terms.
9. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be communicated clearly when reasonably possible. Continued use of the site after changes are posted means you accept them.
10. Governing law and disputes
These Terms are governed by the laws of Portugal. Any dispute arising from these Terms or your use of the site will be subject to the exclusive jurisdiction of the courts of the district of Lisbon, Portugal, unless you have other rights as a consumer under EU law that cannot be waived by contract.
